HOW TO ENTER: NO PURCHASE NECESSARY AND NO ENTRY FEE, PAYMENT OR PROOF OF PURCHASE IS NECESSARY TO PARTICIPATE.
To enter you may use one of three methods. Limit one (1) entry per entrant, provided that entrants may receive additional opportunities to submit entries by sharing a unique URL provided by The Family Tree Garden Center with friends who use it to enter the Contest. Entrants must comply with all applicable laws and third-party terms of use when sharing the URL. When sharing the URL, entrants must include a statement substantially similar to the following: “Help me earn an additional entry by using my link to enter the The Family Tree Garden Center Spring Giveaway.” Entrants will receive one (1) additional entry for every “Referred Entrant.” A “Referred Entrant” is an individual who is eligible for the Contest and submits a valid entry to the Contest by clicking the entrant’s unique URL. The Family Tree Garden Center will text entrant when such entrant has received an additional entry. Entries generated by script, macro, or other automated means are void.

The first method of entry requires you to text Family to 1-833-601-2745. You will be asked to reply with your zip code and then will receive a thank you message with a link to an online form you must fill out to complete the entry. Stay tuned for updates and promotions. Entry Method 2: Online
The second method requires you to fill out and submit the form found online at: https://textfamilytree.com/springgiveaway Upon submitting the online form, you will receive a text from The Family Tree Garden Center asking you to reply with your zip code. You must respond with your zip code in order to complete the entry. Stay tuned for updates. By submitting the online form, you’ve signed up to receive recurring automated text message offers from The Family Tree Garden Center. Entry Method 3: Mail-in
For the third method of entry, legibly hand print your full name, your complete valid postal address (including zip code), date of birth, telephone number, and valid e-mail address on a 3 1⁄2” x 5” card and mail it, in a #10 envelope with proper postage affixed, to: The Family Tree Garden Center

Maximum one (1) entry card will be accepted per stamped outer mailing envelope. Mail-in entries must be postmarked by the last day of the Entry Period and received by April 25, 2022 (“Mail- in Entry Deadline”). Postcards not received by the Mail-in Entry Deadline will be disqualified. The Family Tree Garden Center Parties assume no responsibility for lost, late, incomplete, stolen, misdirected, illegible or postage-due entries or mail, all of which will be void. No mechanically reproduced entries permitted. All entries become the property of The Family Tree Garden Center, and none will be acknowledged or returned. Proof of mailing does not constitute proof of delivery.
ELIGIBILITY: By participating in the Contest, you agree to be fully and unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of The Family Tree Garden Center as final and binding as it relates to the Contest.
You must be 18 years of age or older at time of entry to be eligible for the Contest and a resident of one of the fifty (50) United States or District of Columbia.
Employees of The Family Tree Garden Center, its parent, affiliates, subsidiaries, and promotional agencies, and immediate family members of each (spouse, parent, child, sibling, and their respective spouses, regardless of where they live) or persons living in the same households of such employees, whether related or not, are not eligible.
ENTRY PERIOD: The Contest begins on April 1st, 2022, at 12:00 AM CST and ends on April 30, 2022, at 11:59 pm CST. The Family Tree Garden Center computer clock is the official timekeeping device of the Contest.
PRIZE:
- One (1) winner will receive $250 Gift Card
- Two (2) Winners will receive hanging flower pots ($25 value)
- Three (3) Winners will receive garden success kits ($55 value)
ODDS OF WINNING: This is a game of chance. The odds of winning depend upon the number of eligible entries received.
WINNER SELECTION AND NOTIFICATION: The winner of the Contest will be announced by May 6, 2022. Due to the number of entries, only the winner will be notified. The winner will be notified by phone and e-mail at the phone number and email address provided on the potential winner’s entry.
The potential winner’s right to receive the prize is subject to verification of eligibility, including verification of age and residency. The Family Tree Garden Center also reserves the right to conduct a background check on any potential winner and reserves the right in its sole discretion to disqualify any person and revoke any prize award based on the results of such background check if The Family Tree Garden Center determines in its sole discretion that the award of a prize or prize-related benefits to such person might reflect negatively on The Family Tree Garden Center or any other Family Tree Garden Center Parties or create an unacceptable security or liability risk.
If a potential winner is determined to be ineligible, is otherwise disqualified by The Family Tree Garden Center, or does not respond to The Family Tree Garden Center first attempted notification within 48 hours, The Family Tree Garden Center reserves the right to disqualify that potential winner and, if time permits, select an alternate potential winner in a random drawing from among all remaining eligible entries. If a potential winner is disqualified and there is no time reasonably to select a substitute winner, The Family Tree Garden Center reserves the right not to select a substitute winner and to retain the related prize package.
PUBLICITY: Except where prohibited, by entering any contest, you agree that The Family Tree Garden Center, anyone acting on behalf of The Family Tree Garden Center, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world, your entry, including, without limitation, the entry itself and the winner’s name, biographical information, portrait, picture, voice, likeness, image or statements made by the winner about the Contest, as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation to the winner.
LIMITATIONS OF LIABILITY: By entering the Contest, you agree to release and hold harmless The Family Tree Garden Center and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, the “The Family Tree Garden Center Parties”) from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) your participation in the Contest and/or your acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the The Family Tree Garden Center Contest; or (v) electronic or human error which may occur in the administration of the Contest or the processing of entries, including, without limitation, incorrect, delayed or inaccurate transmission, winner notifications, prize claims or other information or communications relating to the Contest, or the failure to capture or transmit any such information or any errors in these Rules. In the event of any ambiguity or error(s) in these Rules, The Family Tree Garden Center reserves the right to clarify or modify these Rules however it deems appropriate to correct any such ambiguity or error(s). If due to an error or for any other reason, more legitimate prize claims are received than the number of prizes stated in these Rules, The Family Tree Garden Center reserves the right to award only one (1) prize from a random drawing from among all eligible claimants. In no event will more than the stated number of prizes (i.e., one prize package) be awarded.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT A PARTICIPANT, TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE FAMILY TREE GARDEN CENTER RESERVES THE RIGHT TO SEEK DAMAGES AND PURSUE ALL OTHER REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
The Family Tree Garden Center may prohibit an entrant from participating in the Contest or winning the prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the promotion by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or any Family Tree Garden Center Parties.
YOU ALSO AGREE THAT TO THE FULLEST EXTENT PERMITTED BY LAW: (I) UNDER NO CIRCUMSTANCES WILL YOU BE PERMITTED TO OBTAIN ANY AWARD FOR, AND YOU HEREBY KNOWINGLY AND EXPRESSLY WAIVE ALL RIGHT TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, AND/OR ANY RIGHT TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, IN ANY ACTION ARISING OUT OF OR CONNECTED WITH THE CONTEST OR ANY PRIZE AWARDED; AND (II) YOUR REMEDIES ARE LIMITED TO A CLAIM FOR YOUR OUT-OF-POCKET EXPENSES OF PARTICIPATION IN THE CONTEST (IF ANY).
THE FAMILY TREE GARDEN CENTER RESERVATION OF RIGHTS: If the Contest is not capable of running or being fulfilled as planned for any reason, including without limitation, as a result of war, natural disasters or weather events, labor strikes, acts of terrorism, pandemic infection, or other force majeure event or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct and fulfillment of the Contest, The Family Tree Garden Center reserves the right, at its sole discretion, to modify, suspend, or cancel the Contest. In the event of cancellation, The Family Tree Garden Center reserves the right to select a winner from a random drawing from among all non-suspect, eligible entries received as of the date of cancellation.
PRIVACY: Any personally identifiable information collected during an entrant’s participation in the Contest will be collected and used by The Family Tree Garden Center and its designees (i) for the administration and fulfillment of the Contest, (ii) as otherwise described in these Rules, (iii) as set forth in The Family Tree Garden Center privacy policy available at https://taponit.com/familytree-privacy/ , and (iv) to send entrants The Family Tree Garden Center newsletters and offers which may be of interest to entrant.

Receipt of commercial communications from The Family Tree Garden Center, including the receipt of any text messages or commercial e-mail messages, is not a requirement to participate in this Contest and will not affect your eligibility to win.
WINNER LIST: For the name of the winner, send an email to cbaker@thefamilytreeinc.com with “The Family Tree Garden Center Spring Giveaway Winner List” in the subject line. Requests must be received no later than sixty (60) days after the end of the entry period.
